Applicable purchase conditions

The following purchase conditions apply to the sale of swimwear and beachwear as well as other personal property (hereinafter referred to as "the products") by Sunkini, which is owned by the company LO Consulting AB, organization number 559157-5203, below referred to as "Sunkini.com", "Sunkini" or "we", unless otherwise specifically agreed in writing between the respective customer, hereinafter referred to as "the customer" or "you", and Sunkini. When selling to consumers, Sunkini applies the mandatory rules that follow from the applicable legislation. Sunkini's online store (www.sunkini.com) is referred to below as "Sunkini".

1. General

Sunkini.com sells swimwear/beachwear and other beach-related products via the internet to private individuals in Sweden, Europe and the United States. To shop with us, you must be 18 years old and have a valid ID document for parcel shipments . If you are under 18 years of age, you must have consent to your purchase from your guardian.

2. Ordering

Ordering products is done on our website www.sunkini.com. If you have questions about how to order, please contact our customer service. Completed order means that you accept these terms of purchase and consent to your personal data being registered in our customer register. Purchase agreements are made when the customer receives their delivery confirmation. The order confirmation is a confirmation of booked goods with information that the agreed purchase is confirmed when the customer receives their delivery confirmation. In the event of any inaccuracies in e.g. indication of price, stock differences, delivery time, product information etc. we reserve the right to correct this afterwards. If you are not satisfied with our correction, you can of course choose to cancel your order free of charge.

2.1. Order to companies

We only sell to private individuals. You can shop for companies, schools or the like by ordering from Sunkini as a private person and then invoicing the organization that will pay for the purchase. Please research the billing options before placing your order from Sunkini. It is not possible for us to change invoice information afterwards and to issue invoices with company names.

3. Payment

Sunkini uses Klarna Checkout for all payments. You accept Klarna's terms and conditions at checkout when the payment is made. You can read about the different payment options on Klarna's website here.

We also offer payment via Swish. If you are connected to Swish, you have the option of making payments that are deducted directly from your bank account. Open the Swish app on your mobile device and authorize the payment via your mobile Bank ID to complete the purchase.

4. Privacy policy

We may process your personal data when you use Sunkini.com. Information on how we process your personal data can be found in our Privacy policy.

5. Immaterial rights

All content on Sunkini.com, such as text, graphics, logos, images, audio clips, digital downloads and other software, as well as all intellectual property rights related thereto (such as copyrights, print rights, design rights and trademarks), belong to Sunkini or Sunkini's suppliers and are protected by Swedish and international law. You do not acquire any ownership rights to such content or such intellectual property rights through your use of Sunkini.com or through the purchase of products from Sunkini.

6. Shipping and delivery

At Sunkini you get free shipping when you order goods for SEK 500 or more, for orders under SEK 500 a shipping fee of SEK 49 is added. You can choose delivery with Postnord, DHL or pick up directly at our warehouse in Gothenburg, Sweden.

When the goods have left our warehouse, responsibility for delivery passes to the shipping companies who must deliver your order within the specified time. Sunkini cannot provide a delivery guarantee for items that are not in stock when you placed your order or for items that have left our warehouse. This means that the total delivery time before the item reaches you may be longer than what is stated as normal for the selected shipping method if the carrier itself causes a delay.

Once we have shipped your order, you will receive a delivery confirmation with a package number or a tracking link to your email address. Use the tracking number or the tracking link to track your shipment.

6.1. Transport responsibility

If the product is damaged or lost during transport from us to you, we are responsible. In the event of a return to us, it is you as the customer who is responsible for the return being returned correctly based on our return conditions, and you are responsible for your purchased product (including damage caused to the product) until you hand it over to the carrier who will return the product to us. 7. Right of withdrawal and open purchase

The right of withdrawal is valid for 14 days from the day you received your package. Please note that the right of return does not cover products that have been affected due to use. The item must be returned in unaltered condition in its original packaging for a full refund.

We at Sunkini offer 30 days open purchase so you have time to feel whether the product is really for you. Open purchase is valid for 30 days from the day you received your package and on the condition that the item is returned unused and undamaged and that all types of markings, labels and stickers remain on the item.

8. Complaint

If we have delivered a product that is defective, we ask that you contact us within a reasonable time from the time the error was discovered to help you resolve the problem. Complaints must be made in accordance with the instructions you receive from us. Send an email to our customer service with your order number, a detailed description of the error and, in case of instructions, pictures and/or video clips showing the error.

9. Discount codes and conditions for campaigns

9.1. Discount codes

If you want to use a discount or compensation code when placing an order with us, you must do the following:

  1. Put your products in the shopping cart and proceed to checkout.
  2. Under the products in the checkout, click on "Do you have a promotional code?".
  3. Enter the discount code in the box and click "Add".
  4. You will now be able to see the deducted amount at the total amount.

If the code does not work, double-check the spelling and that you have used upper and lower case letters correctly.

​Only one discount code can be used per purchase, as discount codes cannot be combined (regardless of whether they are promotional codes, compensation codes or replacement codes). The total value of the products must be higher than the value of the discount code for the purchase to be completed.

Each discount code has a validity period, and there is neither the possibility to extend the validity period nor to activate a discount code after the validity period has expired.

In the case of products purchased with a promotional code, the code is not replaced upon return, but you will receive a refund of what you have paid at the time of purchase.

9.2. Quantity discounts/Package prices

In a quantity discount, for example 3 for 2, you get the value of the cheapest item deducted at checkout. This value is deducted from the total order amount of the goods affected by the quantity discount.

When returning a product that is affected by a quantity discount/package price, the discount terms expire. If the discount conditions are no longer met, you pay for what your goods would have cost at the regular price.

9.3. Delivery time for promotions

In the case of campaigns, the delivery time may be longer than what is otherwise stated on our website. You can always track your order via the tracking link in your delivery confirmation. If you have questions about your delivery, you can contact our customer service.

10. Force majeure

If our fulfillment of our obligations under these terms or agreements entered into is significantly hindered or prevented due to circumstances beyond our control and which we could not have reasonably foreseen, this shall relieve us from the fulfillment of our obligations, as well as damages and other penalties (so-called force majeure). Such unforeseeable events can be war, natural disasters, industrial action, government decisions, non-delivery by subcontractors, as well as other costly circumstances and events beyond our control.

11. Other conditions

Sunkini has the right to use subcontractors to fulfill our obligations under these terms of purchase. We reserve the right to make changes to these terms at any time.

12. Applicable law and dispute

These terms and conditions of purchase shall be interpreted and applied in accordance with Swedish law, however with the exception of such international private law provisions which entail the application of the law in another jurisdiction.

Complaints or comments regarding Sunkini's services or products should be communicated to our customer service.

If you are not satisfied with our handling of your case, you are welcome to contact your local consumer advisor or the General Complaints Board (ARN) via their website, +46 85 08 860 00 or arn@arn.se. We always follow ARN's recommendations.

If you have a complaint or problem with Sunkini's services or products, and we cannot resolve the dispute between ourselves, you can also send your complaint to the EU's online dispute resolution platform, so-called The ODR platform. The ODR platform offers consumers in the EU an opportunity to try to resolve disputes about complaints about products bought online, without involving a court. By using the ODR platform, you as a consumer can find a body or forum for your complaints. You can find the platform here.
